Welcome to Storytool.io. These Terms of Service ("Terms") govern your access to and use of the Storytool.io website, applications, and related services (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
"Storytool.io", "Storytool", "we", "us", and "our" refer to our company operating the Service.
1. Eligibility and Scope of Service
1.1. Eligibility
You may use the Service only if you:
- Are at least 16 years old, or the minimum age of digital consent in your country.
- Have the power to enter a binding contract with us and are not barred from doing so under any applicable laws.
If you are using the Service on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms. In that case, "you" and "your" will refer to that organization.
1.2. Service Description
Storytool.io provides AI-powered tools that allow you to:
- Convert text into synthetic speech ("Text-to-Speech" or "TTS").
- Convert text (such as stories, scripts, and educational content) into videos ("Text-to-Video").
The Service may also include a web interface, APIs, dashboards, credit systems, and other features as we may introduce from time to time.
1.3. Changes To The Service And Additional Terms
We may modify, suspend, or discontinue any part of the Service at any time, including by adding or removing features, imposing new limits, or changing usage thresholds. Where reasonably possible, we will use reasonable efforts to notify you in advance of material changes.
From time to time, additional terms and policies may apply to specific parts of the Service or to certain programs (for example, our Affiliate Program Terms, which may be made available at https://storytool.io/affiliate-terms). When such additional terms apply, you must agree to them in order to use the relevant features or programs. In case of conflict, those specific terms will prevail for the relevant feature or program.
2. Account Registration and Security
2.1. Account Creation
To use certain parts of the Service, you must create an account and provide accurate, current, and complete information. You agree to keep your account information up to date.
By creating an account, you agree that we may send you service-related communications by email, such as account verification, password resets, billing notifications, security alerts, and important updates about the Service.
You may not opt out of these essential service emails while maintaining an account, because they are necessary for the Service to function.
Separately, we may send you newsletters, tips, or promotional emails where you have opted in or where permitted by law. You can unsubscribe from marketing emails at any time by using the "unsubscribe" link in the email or by changing your email preferences in your account, while still receiving essential service emails.
2.2. Account Security
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to:
- Promptly notify us at info@storytool.io of any unauthorized use or suspected breach of security.
- Log out of your account at the end of each session on shared devices.
We are not liable for any loss or damage arising from your failure to safeguard your account credentials.
3. Subscriptions, Payments, and Refunds
3.1. Subscriptions and Billing
Access to certain features of the Service is provided on a subscription basis (for example, monthly plans). When you subscribe:
- You authorize us and/or our payment partner to charge you the subscription fee and any applicable taxes on a recurring basis until you cancel.
- Unless stated otherwise, subscriptions automatically renew for successive periods of one (1) month at the then-current price.
3.2. Payment Processing Via Merchant Of Record
Payments, taxes, refunds, and chargebacks for paid subscriptions are processed by our payment partner Lemon Squeezy, which acts as the merchant of record for your purchases. Lemon Squeezy handles collection of payments, applicable sales taxes/VAT, and chargeback management under its own terms and policies.
Your payment information is processed and stored by Lemon Squeezy or its payment processors, not by Storytool directly.
3.3. Prices and Taxes
We may change subscription prices at any time. Price changes will apply to the next billing cycle and, where required, we will notify you in advance. Prices may exclude or include taxes depending on your location; any applicable taxes will be shown at checkout.
3.4. Refunds (Storytool Policy)
Digital subscriptions and credits are generally non-refundable. However, we may, at our discretion, offer a refund in the following limited cases:
For first-time charges of a subscription period, you may request a refund within 48 hours of purchase if you:
- Were unable to use the Service due to a technical issue for which we are responsible.
- Provide reasonable information to help us diagnose and address the issue.
Outside of this 48-hour window, all fees are non-refundable, except where required by applicable law.
Because Lemon Squeezy acts as merchant of record, Lemon Squeezy may still issue refunds or reverse transactions at its own discretion (for example, in fraud or chargeback situations), regardless of our internal refund policy.
3.5. Failed Payments and Cancellation
If we cannot process your payment:
- We may temporarily suspend or downgrade your access to the Service.
- You remain responsible for paying any amounts due.
You may cancel your subscription at any time in your account settings or via the link provided in your billing emails. Cancellation will take effect at the end of the current billing period, and you will not receive a refund for any remaining time unless required by law.
4. Credits, Free Plans, and Trials
4.1. Credits
The Service may use credits as a unit of usage (for example, per character of text-to-speech or per minute of generated video). Credits may be:
- Purchased as part of a plan.
- Granted as free or promotional credits.
We may specify usage rules and limits for credits within the Service or on our website.
4.2. Expiration and Non-Refundability
Unless explicitly stated otherwise:
- Paid credits associated with active subscriptions are valid for the period defined in your plan.
- Free or promotional credits may have additional restrictions or shorter validity, which will be explained at the time of issuance.
Credits have no cash value, are non-transferable, and are non-refundable, except where required by law.
4.3. Free Trials and Promotional Access
We may offer free trials, beta features, or promotional access with limited usage. We may change or end such offers at any time. If you do not upgrade before the end of a trial, your access may be reduced or disabled.
5. User Content
5.1. Definition
"User Content" means any text, scripts, stories, prompts, metadata, images, audio, video, or other content that you upload, submit, or provide to the Service, including any data you provide via API.
5.2. Ownership
You retain all rights to your User Content. We do not claim ownership of your User Content.
5.3. Your Responsibilities
You are solely responsible for your User Content and for ensuring that it:
- Does not infringe or violate any intellectual property, privacy, or other rights of any third party.
- Complies with all applicable laws and regulations.
- Complies with these Terms, including the Acceptable Use section.
You acknowledge that we do not monitor or pre-approve all User Content, but we reserve the right to remove or restrict access to any User Content that we reasonably believe violates these Terms or applicable law.
You are solely responsible for all text, images, audio, video, and other content that you upload to or generate through the Service ("User Content").
By submitting User Content, you represent and warrant that:
- You have all necessary rights, licenses, and permissions to use, upload, and process the User Content through the Service.
- Your User Content and your use of the Service do not infringe or violate any third-party rights, including copyrights, trademarks, rights of publicity or privacy, or other proprietary rights.
- Without limitation, you will not intentionally use the Service to create, upload, or distribute content that uses or closely imitates protected characters, logos, brands, or other copyrighted material (for example, well-known cartoon, anime, game, or movie characters) unless you have obtained all necessary permissions from the rights holders.
We do not have an obligation to monitor all User Content and we do not pre-approve or pre-screen every project. However, we reserve the right (but are not obligated) to review, disable, or remove any User Content at our discretion if we reasonably believe it may violate these Terms, infringe third-party rights, or create legal or security risk.
5.4. License to Storytool
To operate and improve the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, display, and perform your User Content:
- To provide the Service to you and other users (including via third-party AI providers).
- To maintain and improve the performance, security, and reliability of the Service (for example, via logging, debugging, analytics, and abuse detection).
- To comply with law and enforce these Terms.
This license is limited to the above purposes and continues for as long as your User Content is stored in our systems.
5.5. No Training on User Content
We do not use your User Content or Generated Content to train or fine-tune our own or third-party foundation models, except as permitted by those third-party providers' policies that themselves may avoid using API data for training by default.
Our third-party AI providers may log and process data for security, abuse monitoring, or product improvement, as described in their own terms and policies.
6. Generated Content and Community Content
6.1. Generated Content
"Generated Content" means outputs produced by the Service based on your inputs, including synthetic speech, video, images, and any associated metadata.
6.2. Ownership of Generated Content
Subject to these Terms and applicable law, and to the rights of any third parties in underlying materials you provide, you own your Generated Content and may use it for any lawful purpose, including commercial use, at your own risk.
You are responsible for ensuring that your use of Generated Content complies with:
- Third-party platform rules (for example, YouTube, TikTok, podcast platforms).
- All applicable laws (including copyright and personality rights).
6.3. License to Storytool for Generated Content
To operate the Service and support you, you grant us a worldwide, non-exclusive, royalty-free license to host, process, store, and transmit your Generated Content for:
- Providing features such as preview, download, history, and collaboration.
- Internal testing, debugging, and analytics.
- Legal compliance and enforcement of these Terms.
6.4. Community Content (Free Credits and Promotions)
We may sometimes designate certain Generated Content as "Community Content", for example content created using:
- Free trial plans.
- Free or promotional credits.
- Specific community or showcase campaigns clearly marked as such in the Service or our communications.
For Community Content, in addition to your rights, you grant us a perpetual, worldwide, irrevocable, royalty-free, sublicensable license to:
- Use, reproduce, modify, adapt, translate, publish, distribute, publicly perform, and publicly display such Community Content.
- Use it for marketing, portfolio, case studies, product demos, and other promotional purposes.
- Display it on our website, social channels, or in our materials, with or without attribution to you (unless you and we agree otherwise in writing).
We will use reasonable care not to reveal your confidential or personally identifiable information in connection with Community Content.
6.5. No Guarantee of Originality
You understand and agree that:
- Generated Content is produced by AI models that may generate similar or identical outputs for different users.
- We cannot guarantee that Generated Content is unique or will not resemble existing works.
- It is your responsibility to review Generated Content and, where necessary, obtain any additional rights or permissions.
7. Acceptable Use Policy
You agree not to use the Service to:
7.1. Illegal or Harmful Content
- Create, upload, or distribute content that is illegal, harmful, fraudulent, misleading, defamatory, harassing, hateful, or discriminatory.
- Promote self-harm, violence, terrorism, or extremist organizations.
- Create or disseminate sexually explicit content, especially involving minors or non-consenting individuals.
7.2. Intellectual Property and Privacy Violations
- Infringe any copyright, trademark, trade secret, or other intellectual property right.
- Violate any privacy, publicity, or personality rights (including deepfakes or synthetic media that mislead viewers about a person's identity or endorsement).
7.3. Abuse, Spam, or Platform Violations
- Generate large volumes of spam content or unsolicited messages.
- Circumvent or attempt to circumvent safety filters or usage limits of the Service or our AI providers.
- Use the Service to violate the terms of third-party platforms (for example, content rules of YouTube, TikTok).
7.4. Security and Technical Misuse
- Reverse engineer, decompile, or attempt to extract source code or model parameters.
- Interfere with or disrupt the integrity or performance of the Service.
- Attempt unauthorized access to our systems, other accounts, or data.
We may investigate and take appropriate action (including content removal, account suspension, or termination) if we reasonably believe that you have violated this Acceptable Use Policy.
8. Third-Party Services and AI Providers
8.1. Third-Party AI Providers
The Service integrates with third-party AI services (such as those provided by OpenAI, Google, and others). These providers operate under their own terms of service and policies, including usage and safety policies.
By using the Service, you also agree to comply with those applicable policies.
8.2. No Control Over Third-Party Services
We do not control and are not responsible for:
- The uptime or availability of third-party services.
- Changes to their pricing, features, or policies.
- Any errors, delays, or limitations introduced by those services.
If a third-party provider changes or discontinues its services, we may adapt, limit, or suspend corresponding features in the Service.
9. Affiliate and Referral Programs
If you choose to participate in any affiliate, referral, or influencer program that we offer:
- Your participation may be subject to additional Affiliate Program Terms or similar agreements, which will be presented to you at sign-up or made available on a dedicated page (for example, at https://storytool.io/affiliate-terms).
- Those terms will govern matters such as commission rates, payout schedules, eligible referrals, prohibited promotional methods (for example, spam), and fraud prevention.
In the event of any conflict between these Terms and the Affiliate Program Terms, the Affiliate Program Terms will govern your participation in that program.
We may modify or discontinue any affiliate or referral program at any time.
10. Intellectual Property Rights (Storytool)
10.1. Our Materials
The Service, including its software, interfaces, designs, graphics, trademarks, and all other content created by or for Storytool (excluding User Content and Generated Content) are owned by us or our licensors and are protected by intellectual property laws.
10.2. Limited License to You
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own internal and commercial purposes, in accordance with these Terms and applicable law.
You may not:
- Copy, distribute, modify, or create derivative works of the Service or any part thereof, except as expressly permitted.
- Remove or alter any copyright, trademark, or other proprietary notices.
11. Privacy and Data Protection
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data.
By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.
If you handle personal data of third parties when using the Service (for example, user names or voices), you are responsible for complying with applicable data protection laws and obtaining any necessary consents.
12. Service Availability and Changes
We strive to provide a reliable Service, but we do not guarantee that the Service will be:
- Available at all times or uninterrupted.
- Free from errors, security vulnerabilities, or delays.
We may temporarily suspend or limit access to the Service:
- For maintenance, upgrades, or security reasons.
- Due to events beyond our reasonable control.
- If we reasonably suspect a violation of these Terms.
13. Termination
13.1. By You
You may stop using the Service at any time and may request account deletion as described in the Service or by contacting us at info@storytool.io.
13.2. By Us
We may suspend or terminate your access to the Service, in whole or in part, if:
- You materially or repeatedly breach these Terms or applicable law.
- We are required to do so by law or by our third-party providers.
- Continued provision of the Service is no longer commercially or technically feasible.
Where reasonable, we will provide notice before termination. Certain provisions of these Terms will survive termination, including those relating to intellectual property, limitations of liability, and dispute resolution.
13.3. Effect of Termination
Upon termination:
- Your right to use the Service will cease.
- We may retain certain data for legal, security, or operational reasons, in accordance with our Privacy Policy.
14. Disclaimers
The Service, including all Generated Content, is provided on an "as is" and "as available" basis.
To the maximum extent permitted by law, we and our suppliers and licensors:
- Disclaim all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- Do not warrant that the Service or Generated Content will be accurate, complete, reliable, error-free, secure, or suitable for your specific use case.
Any content or output you obtain through the Service is at your own risk. You are solely responsible for reviewing and verifying Generated Content before using it, especially for legal, medical, financial, or historical claims.
The Service may produce content automatically using machine-learning and generative AI models. Such content is generated based on patterns learned from large datasets and from your prompts, and we do not guarantee that any output will be unique, original, free of errors, or non-infringing.
You are responsible for reviewing AI-generated content before using, publishing, or distributing it, and for ensuring that your use of such content complies with all applicable laws and third-party rights. Storytool.io is not liable for any claims or damages arising from your use of AI-generated content, including any alleged infringement of intellectual property or other rights.
Nothing in the Service constitutes legal, financial, medical, or other professional advice.
15. Limitation of Liability
To the maximum extent permitted by law:
- We will not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service or these Terms, even if we have been advised of the possibility of such damages.
- Our total aggregate liability for all claims arising out of or relating to the Service or these Terms will not exceed the amount you paid to us for the Service during the three (3) months immediately preceding the event giving rise to the claim.
Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.
Indemnity For User Content And Use Of The Service
You agree to defend, indemnify, and hold harmless Storytool.io and our affiliates, officers, directors, employees, and contractors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of or access to the Service;
- Your User Content, including any allegation that your User Content or your use of AI-generated content infringes or violates any intellectual property right, privacy right, or other right of any person or entity;
- Your violation of these Terms or of any applicable law or regulation.
We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with our defense of such claims.
16. Indemnification
You agree to indemnify, defend, and hold harmless Storytool and its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:
- Your use of the Service.
- Your User Content or Generated Content.
- Your violation of these Terms or any applicable law.
- Your violation of any rights of another person or entity.
17. Changes to These Terms
We may update these Terms from time to time. When we do, we will:
- Update the "Last updated" date at the top of this page.
- Where appropriate, provide additional notice (such as via email or in-product notification).
Your continued use of the Service after the updated Terms have been posted constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service.
18. Discontinuation of the Service
We may decide to discontinue the Service in whole or in part. In such cases, we will use reasonable efforts to provide at least 30 days' prior notice via the Service or email.
In the event of discontinuation:
- You should download or export any necessary data or Generated Content before the Service becomes unavailable.
- We will not be obligated to provide refunds for unused credits or remaining subscription periods, except where required by law.
19. Governing Law and Dispute Resolution
For legal purposes, Storytool.io is operated by QUANG HANH PHAI,.JSC., a company registered in Vietnam.
These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of Vietnam, without regard to its conflict-of-laws rules.
You and we agree to submit to the exclusive jurisdiction of the courts located in Vietnam to resolve any dispute arising from or relating to these Terms or the Service, except where applicable law gives you the right to bring claims in your local courts.
If you are a consumer located in a jurisdiction that provides mandatory consumer protections, nothing in these Terms limits those protections.
20. Language and Translations
We may provide translations of these Terms into other languages for your convenience. In the event of any inconsistency or conflict between the English version and any translated version, the English version will prevail.
